TERMS & CONDITIONS

This agreement forms a contract between you the Client and Kudos Driving and its representatives

REVISED October 2026

This document contains the Terms and Conditions for "Kudos Driving". It is based on the “Code of Practice for Approved Driving Instructors”. These are intended to protect the interests of both the Client and Kudos Driving and its representatives. The Client is strongly recommended to be familiar with its contents before entering into any agreement with Kudos Driving and its representatives. You may also wish to seek advice from an independent party


Please read these Terms & Conditions carefully before signing.

These Terms & Conditions (“Terms”) apply to driving tuition and related services provided by Kudos Driving (“Kudos Driving”, “we”, “us” or “our”) to the person receiving tuition (“Client”, “you” or “your”).

These Terms are intended to explain clearly how driving tuition is provided, the responsibilities of both parties, arrangements for payment and cancellation, safety requirements, privacy, photography and other relevant matters.

Nothing in these Terms is intended to exclude, restrict or waive any statutory right or remedy that cannot lawfully be excluded, restricted or waived.


1. LESSON APPOINTMENTS

1.1 Driving lessons will be arranged by mutual agreement between the Client and Kudos Driving.

1.2 Lesson dates, times and collection arrangements should be agreed in advance wherever reasonably practicable.

1.3 Kudos Driving may maintain records of lessons, including dates, duration, payments, progress and matters relevant to the provision of tuition.

1.4 The Client is responsible for attending lessons at the agreed time and location and being ready and legally permitted to drive.

1.5 Where reasonably practicable, Kudos Driving will confirm agreed lesson arrangements.


2. DRIVING LICENCE, FITNESS AND LEGAL ENTITLEMENT

2.1 The Client must hold the appropriate valid licence or provisional licence and meet all legal requirements necessary to receive driving tuition.

2.2 The Client must inform Kudos Driving of any change affecting their legal entitlement or ability to drive.

2.3 The Client must not undertake a lesson if affected by alcohol, illegal drugs, medication, illness, fatigue or any other circumstance that makes driving unsafe or unlawful.

2.4 The Client is responsible for providing accurate information relevant to their legal entitlement and ability to drive safely.

2.5 Where Kudos Driving reasonably considers that continuing a lesson would be unsafe or unlawful, the lesson may be stopped or postponed.


3. SAFETY AND CLIENT WELLBEING

3.1 Safety is the first priority during every driving lesson.

3.2 The Client must follow reasonable safety instructions given by the instructor.

3.3 The instructor may intervene through the vehicle’s controls where reasonably necessary to prevent or reduce an immediate safety risk.

3.4 The Client must not deliberately interfere with the instructor’s ability to control the vehicle.

3.5 If the Client becomes unwell, distressed, overwhelmed, fatigued or otherwise unable to continue safely, they should inform the instructor as soon as it is safe to do so.

3.6 Where appropriate, the instructor may stop in a safe and lawful location to allow the Client to recover before deciding whether the lesson can continue.


4. RESPECTFUL BEHAVIOUR AND SAFETY BOUNDARIES

4.1 Kudos Driving is committed to treating Clients with dignity, patience, professionalism and respect.

4.2 Clients are expected to behave respectfully towards the instructor and other road users.

4.3 A lesson may be stopped where the Client’s conduct creates a significant or immediate safety risk, including:

  • physical aggression;

  • threatening behaviour;

  • deliberately interfering with vehicle controls;

  • deliberately preventing the instructor from controlling the vehicle;

  • conduct that materially compromises safe vehicle operation; or

  • serious abusive behaviour that makes it unsafe or unreasonable to continue.


4.4 Where circumstances permit, the instructor will seek to de-escalate difficult situations and discuss an appropriate way forward.

4.5 Anxiety, distress, sensory overload, frustration or becoming upset will not, by themselves, be treated as misconduct.

4.6 This section should be read together with Section 5 concerning inclusive learning, neurodiversity and communication needs.


5. INCLUSIVE LEARNING, NEURODIVERSITY AND COMMUNICATION NEEDS

5.1 Inclusive and Supportive Instruction

Kudos Driving is committed to providing a professional, respectful, accessible and supportive learning environment for all Clients.

We recognise that people learn in different ways and that some Clients may have neurodivergent characteristics, disabilities, anxiety, sensory sensitivities, communication differences or other learning needs.

Where reasonably practicable and consistent with road safety, legal requirements and the capabilities of the vehicle and instructor, Kudos Driving will seek to adapt its teaching approach to support the Client’s individual learning and communication needs.

5.2 Sharing Learning Needs and Preferences

Clients are encouraged, but are not required, to tell Kudos Driving about any learning needs, communication preferences, sensory sensitivities, disabilities or other circumstances that may affect their driving tuition.

Clients do not need to disclose a medical diagnosis simply to request a teaching adjustment.

For example, a Client may tell the instructor that they:

  • process spoken instructions more slowly;

  • prefer one instruction at a time;

  • benefit from visual explanations;

  • find certain sounds distracting; or

  • need an occasional short break.


Possible adjustments may include, where reasonably practicable:

  • clear, concise or differently structured instructions;

  • additional processing time where this can be done safely;

  • visual explanations or demonstrations;

  • breaking complex tasks into smaller stages;

  • additional explanation or repetition;

  • a predictable lesson structure or routine;

  • appropriate sensory or comfort breaks; and

  • reasonable adjustments to the vehicle environment, such as radio volume, ventilation or temperature.


Providing information about a learning or communication need will not, of itself, prevent a Client from receiving tuition.

Any adjustment must remain compatible with safe driving and the instructor’s legal and professional responsibilities.

5.3 Reasonable Adjustments

Kudos Driving will consider reasonable adjustments on an individual basis.

An adjustment may not be possible where it would compromise road safety, vehicle control, the safety of the instructor or other road users, legal requirements or the effective delivery of driving instruction.

Where a requested adjustment cannot reasonably be provided, Kudos Driving will, where practicable, discuss an alternative approach with the Client.

Nothing in these Terms is intended to limit any rights the Client may have under applicable equality or consumer-protection legislation.

5.4 Communication During Lessons

Driving instruction requires clear, direct and sometimes immediate instructions, particularly where a developing hazard or potential danger is identified.

Corrections, safety instructions and post-lesson feedback are provided for instructional and road-safety purposes. They are not intended to criticise, embarrass, insult or personally demean a Client.

Clients are encouraged to tell the instructor, when it is safe to do so, if an explanation, teaching method or communication approach is causing difficulty.

5.5 Anxiety, Overwhelm and Sensory Needs

Kudos Driving recognises that driving lessons can be challenging or overwhelming for some Clients.

Where a Client becomes anxious, distressed or sensory-overloaded, they should inform the instructor as soon as it is safe to do so.

Where appropriate, the instructor may bring the vehicle to a safe and lawful location and allow a reasonable break.

If the Client is unable to continue safely, the lesson may need to be paused or ended.

Any decision to end or suspend a lesson for safety reasons will be made reasonably and with the Client’s welfare and road safety in mind.

5.6 Respectful Behaviour and Safety Boundaries

Kudos Driving will treat Clients with patience, dignity and respect, including where a Client is experiencing anxiety, distress, frustration or sensory overload.

At the same time, all Clients are expected to behave in a manner that does not place themselves, the instructor or other road users at unreasonable risk.

A lesson may be stopped immediately where a Client’s behaviour creates a significant and immediate safety risk.

Where reasonably possible, Kudos Driving will distinguish between behaviour arising from distress or overwhelm and deliberate or continuing unsafe conduct.

5.7 Sensory and Vehicle Environment Adjustments

Within reasonable limits, Clients may request adjustments to the vehicle environment, including radio volume, ventilation and temperature.

Such adjustments remain subject to road safety, vehicle operation, weather conditions and applicable legal or manufacturer requirements.

5.8 Immediate Safety Instructions

The safety of the Client, instructor and other road users takes priority during every lesson.

In an emerging hazard or emergency situation, the instructor may need to use a firm, urgent or raised voice, or a short command such as:

“STOP”, “BRAKE”, “LOOK LEFT”

or a similar instruction intended to obtain the Client’s immediate attention.

The purpose of such an instruction is to manage an immediate safety risk.

Where an immediate safety instruction is given while the vehicle is moving, the Client is expected to respond promptly and appropriately and prioritise vehicle and road safety.

Any disagreement, concern or discussion about the instruction should take place once the vehicle is stationary in a safe and lawful location.

A Client will not be criticised merely for becoming upset, anxious or distressed following a safety intervention.

However, deliberately disregarding a safety-critical instruction, or continuing conduct that creates a significant safety risk, may require the lesson to be stopped.

5.9 Review of Adjustments

Learning and communication needs may change over time.

Clients are encouraged to discuss whether an existing adjustment is working effectively.

Kudos Driving may review or amend an adjustment where necessary to maintain road safety or ensure that the teaching approach remains appropriate.

5.10 Information About Learning Needs

Information provided by a Client about a disability, neurodivergence, health, learning need or communication preference will be handled in accordance with the Kudos Driving Privacy Notice and applicable data-protection law.

Clients should only provide information relevant to their tuition or safety.

Kudos Driving will not require a Client to disclose a diagnosis merely for the purpose of considering an appropriate teaching adjustment.


6. TUITION FEES AND PAYMENT

6.1 Tuition must be paid in accordance with the prices and payment arrangements communicated by Kudos Driving.

6.2 Unless otherwise agreed, payment is required before or at the time of the lesson.

6.3 Prepaid packages must be paid in accordance with the applicable package terms.

6.4 Appropriate payment confirmation or receipts will be provided where applicable.

6.5 Prices may change for future bookings, but a price already agreed for a prepaid service will not be retrospectively increased.


7. LESSONS CANCELLED BY KUDOS DRIVING

7.1 Kudos Driving may occasionally need to cancel or postpone a lesson because of instructor illness, vehicle problems, severe weather, emergencies or circumstances outside reasonable control.

7.2 Where reasonably practicable, as much notice as possible will be provided.

7.3 Where a prepaid lesson cannot be provided, Kudos Driving will offer an alternative appointment or refund the amount relating to the lesson not provided, as appropriate.

7.4 Nothing in this section limits statutory rights.


8. CANCELLATION OR POSTPONEMENT BY THE CLIENT

8.1 Clients should provide as much notice as possible when cancelling or rearranging a lesson.

8.2 Where less than 48 hours’ notice is given, Kudos Driving may charge the normal lesson rate where the appointment cannot reasonably be filled by another Client.

8.3 No charge will be made where the appointment can reasonably be reallocated, unless another lawful and proportionate amount is properly due.

8.4 A Client who does not attend without reasonable notice may be charged where Kudos Driving has suffered a genuine direct loss that could not reasonably have been avoided.

8.5 Kudos Driving will take reasonable steps to minimise losses arising from cancellations, including attempting to reallocate appointments where practicable.

8.6 Cancellation charges will not be applied in a manner that results in Kudos Driving recovering more than its reasonable direct loss.

8.7 Nothing in this section affects statutory cancellation rights.


9. REFUNDS

9.1 Kudos Driving will provide refunds where required by law and in accordance with these Terms.

9.2 Where a Client has paid in advance for lessons that have not been provided, the unused portion will normally remain available for tuition or, where the Client ends the agreement, be refunded subject to any lawful and proportionate amounts properly due.

9.3 Where a Client cancels a prepaid course or package before all tuition has been provided, any refund will be calculated fairly, taking into account:

  • tuition and other services already supplied;

  • the price actually paid;

  • any discount forming part of the agreed package price;

  • any cancellation charge that is reasonable and proportionate to actual direct loss; and

  • any other amount required by law.


9.4 Kudos Driving will take reasonable steps to minimise any loss resulting from cancellation.

9.5 Kudos Driving will not automatically retain all or part of a prepaid package merely because a Client decides not to continue.

9.6 A cancellation charge will not be applied if it would result in Kudos Driving recovering more than its reasonable direct loss.

9.7 If Kudos Driving cancels a prepaid course or is unable to provide prepaid tuition, the Client will be offered an appropriate alternative or a refund for tuition not provided.

9.8 Where statutory cancellation rights apply to a distance or off-premises contract, those rights apply in addition to these Terms.

9.9 Where a Client expressly requests that tuition begins during a statutory cancellation period, Kudos Driving may be entitled to receive a proportionate payment for services supplied before cancellation, where permitted by law.

9.10 Refunds will normally be made using the original payment method unless otherwise agreed or required by law.


10. DRIVING TESTS

10.1 The Client is responsible for ensuring that they are eligible and ready to take a practical driving test.

10.2 The instructor may advise the Client regarding readiness for test but cannot guarantee that the Client will pass.

10.3 Where Kudos Driving provides the test vehicle or test representation, the applicable fee will be communicated in advance.

10.4 Kudos Driving does not control DVSA test availability, waiting times, examiner decisions or test outcomes.

10.5 If a test is cancelled by the DVSA, any entitlement to reimbursement or expenses will be dealt with in accordance with the applicable DVSA arrangements.

10.6 If a test is cancelled because of the Client’s actions or circumstances, the Client may remain responsible for reasonable costs incurred where those costs cannot reasonably be recovered or avoided.


11. KUDOS DRIVING’S COMMITMENT

11.1 Kudos Driving will seek to provide tuition professionally, safely and in accordance with applicable professional standards.

11.2 Instruction will be adapted to the Client’s progress and, where reasonably practicable, their learning and communication needs.

11.3 The instructor will provide appropriate feedback regarding driving performance and areas requiring further development.

11.4 No instructor can guarantee a particular test result, learning timescale or number of lessons required to reach test standard.


12. LESSONS IN THE CLIENT’S OWN VEHICLE

12.1 Where tuition is provided in the Client’s vehicle, the vehicle must be suitable, roadworthy, legally compliant and appropriately insured.

12.2 The Client must ensure that the instructor is legally permitted to provide tuition in the vehicle.

12.3 Kudos Driving may decline to provide tuition in a vehicle considered unsafe or unsuitable.

12.4 Where a vehicle becomes unsafe during a lesson, the lesson may be stopped.


13. VEHICLE AND INSURANCE

13.1 Kudos Driving will maintain appropriate insurance for vehicles used in connection with tuition where required.

13.2 Clients must comply with reasonable vehicle safety instructions.

13.3 The Client must notify Kudos Driving of any relevant change affecting their ability to drive safely or legally.


14. LIABILITY AND STATUTORY RIGHTS

14.1 Kudos Driving will exercise reasonable care and skill in providing driving tuition.

14.2 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

14.3 Nothing in these Terms excludes or restricts the Client’s statutory rights.

14.4 Subject to applicable law, Kudos Driving is not responsible for loss arising from circumstances outside its reasonable control.

14.5 Where the law permits liability to be limited, any limitation applies only to the extent permitted by law.


15. COMPLAINTS

15.1 Kudos Driving aims to resolve concerns promptly, fairly and professionally.

15.2 Clients should raise concerns as soon as reasonably practicable so that they can be investigated while the relevant circumstances remain clear.

15.3 A Client will not lose a statutory right merely because a complaint was not made within a particular period.

15.4 Complaints may concern tuition, communication, safety, reasonable adjustments, payments, administration or any other aspect of the service.

15.5 Kudos Driving will consider complaints fairly and seek to provide an appropriate response.

15.6 Nothing prevents a Client from contacting an appropriate regulatory or consumer-protection body where necessary.


16. CURRENT FEES AND RATES

Unless otherwise agreed, the current advertised rates are:

Primary Coverage Area

Standard course pricing and lesson pickups apply to locations within our core operational zone: Chippenham, Corsham, Calne, and their immediate surrounding areas.

Out-of-Area Surcharges

For bookings, intensive courses, or test representations requested outside our standard coverage area, additional fees apply to cover travel time, additional mileage, and fuel expenses.

 Additional Travel Charge: £0.75 per mile (calculated for round-trip travel beyond the outer boundary of our core zones) OR a flat daily travel surcharge (quoted upon initial inquiry).

 Extended Travel Time: If travel time to your pickup location or specified test center exceeds 30 minutes each way from our primary zone, travel time will either be deducted from your total course hours or billed at an adjusted rate of £30/hour.

62 hours – £2,600

Includes tuition and test representation as specified at purchase.

Unlimited Tuition Driving Course

£3,850

This course provides tuition and test representation in accordance with the package terms agreed with the Client.

The course does not guarantee a pass.

Passing a driving test depends upon the Client’s performance and the independent decision of the DVSA examiner.

Test Vehicle Hire

£90, where applicable.

Prices may be amended for future bookings. The price applicable to a prepaid service will be the price agreed at purchase.


17. OFFERS AND PROMOTIONS

17.1 Promotional offers are subject to the specific conditions communicated at the time of purchase.

17.2 Promotional offers do not remove statutory consumer rights.

17.3 Any expiry date or restriction applying to a prepaid package will be communicated before purchase.

17.4 Kudos Driving will not describe an offer as “guaranteed” in a manner that could reasonably imply a guaranteed DVSA test result where no such guarantee exists.

17.5 Promotional claims, testimonials and pass-rate claims will be presented accurately and must not be materially misleading.


18. PUNCTUALITY AND COLLECTION

18.1 Clients should be ready at the agreed collection point at the agreed time.

18.2 Where a Client is late, the lesson will normally finish at the originally agreed time unless an extension is mutually agreed and practicable.

18.3 Where an instructor is delayed, Kudos Driving will seek to provide the agreed tuition time where reasonably practicable.

18.4 Collection and drop-off locations must be suitable and lawful for stopping.


19. PHOTOGRAPHY, VIDEO AND PROMOTIONAL MATERIAL

19.1 Kudos Driving may invite Clients to participate in photography, video, testimonials or other promotional activities.

19.2 Participation is voluntary and is not a condition of receiving driving tuition.

19.3 Acceptance of these Terms does not constitute consent to use an identifiable Client’s photograph, video or testimonial for promotional purposes.

19.4 Separate written or electronic consent will be obtained where required.

19.5 Consent may be requested separately for different channels or purposes, including:

  • Kudos Driving’s website;

  • Facebook;

  • Instagram;

  • TikTok;

  • other official social-media channels;

  • printed promotional material; and

  • digital advertising.


19.6 Consent may also be requested separately for use of:

  • the Client’s first name;

  • a testimonial or review;

  • photography;

  • video; and

  • reasonable editing, cropping or formatting.


19.7 Consent is voluntary.

19.8 Consent may be withdrawn using the contact details in the Privacy Notice.

19.9 Withdrawal does not affect the lawfulness of processing carried out before withdrawal.

19.10 Where consent is withdrawn, Kudos Driving will take reasonable steps to stop future use of the relevant material on channels under its control, subject to applicable law and technical limitations.

19.11 Kudos Driving cannot guarantee removal of material already copied, reposted or shared by third parties.


20. DASHCAM AND IN-CAR RECORDING

20.1 Kudos Driving may use dashcam or other in-car recording equipment for legitimate purposes including safety, incident investigation, insurance and legal protection, subject to applicable data-protection law.

20.2 Where recording includes identifiable Client images or audio, appropriate information will be provided.

20.3 Where consent is required for a particular recording or use, appropriate consent will be obtained.

20.4 Audio recording will not automatically be assumed to be authorised merely because video recording is taking place.

20.5 Recordings will be retained only for as long as reasonably necessary for the relevant purpose and in accordance with the Privacy Notice.

20.6 Clients may raise questions regarding recording using the contact details in the Privacy Notice.


21. PERSONAL DATA AND PRIVACY

21.1 Kudos Driving will process personal data in accordance with applicable UK data-protection legislation.

21.2 The Kudos Driving Privacy Notice explains:

  • what information is collected;

  • why it is collected;

  • the applicable lawful basis;

  • how information is used;

  • who it may be shared with;

  • how long it is retained;

  • applicable individual rights; and

  • how Clients can contact Kudos Driving.


21.3 Where Kudos Driving relies on consent, consent will be obtained in accordance with applicable data-protection requirements and can be withdrawn where applicable.

21.4 Where information concerning health or another special category of personal data is provided, Kudos Driving will identify an appropriate lawful basis and applicable Article 9 condition where required.

21.5 Clients should avoid providing unnecessary sensitive information.

21.6 Personal information will not be sold to third parties.


22. SAFEGUARDING AND PROFESSIONAL CONDUCT

22.1 Kudos Driving is committed to maintaining appropriate professional boundaries between instructors and Clients.

22.2 Any concern regarding inappropriate conduct, safeguarding or professional behaviour should be reported promptly.

22.3 Where a safeguarding concern arises, Kudos Driving may take reasonable steps to protect the Client, instructor or another person and may make an appropriate referral where legally or professionally required.


23. CLIENTS UNDER 18

23.1 Clients under 18 may receive driving tuition subject to applicable legal requirements.

23.2 Kudos Driving will communicate appropriately with younger Clients and maintain appropriate professional boundaries.

23.3 Where appropriate and lawful, Kudos Driving may communicate with a parent, guardian or person with parental responsibility regarding practical arrangements or safeguarding.

23.4 Promotional photography, video or testimonials involving an under-18 Client will be dealt with through the separate media-consent process.


24. CHANGES TO THESE TERMS

24.1 Kudos Driving may update these Terms to reflect changes in law, regulation, professional practice, services or administration.

24.2 Changes will not retrospectively alter rights or obligations that have already arisen unless permitted by law.

24.3 Where a material change affects an ongoing arrangement, appropriate notice will be provided where required.


25. ENTIRE AGREEMENT AND STATUTORY RIGHTS

25.1 These Terms, together with any specific package terms, agreed booking arrangements and the Kudos Driving Privacy Notice, set out the basis on which tuition is provided.

25.2 If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

25.3 Nothing in these Terms is intended to exclude, restrict or waive any statutory right or remedy that cannot lawfully be excluded, restricted or waived.

25.4 Where a statutory right conflicts with a provision of these Terms, the statutory right will prevail to the extent required by law.


26. Payments

Payments can be made through Bank Transfer, Apple Pay, PayPal, Debit or Credit Card or Cash.  All funds are required to be cleared prior to the commencement of any lesson.


CLIENT ACCEPTANCE

I confirm that I have been given an opportunity to read and understand these Terms & Conditions before receiving driving tuition.

I understand that:

  • driving tuition requires me to follow reasonable safety instructions;

  • I may tell Kudos Driving about learning, communication or sensory needs if I wish to request support or an adjustment;

  • reasonable adjustments will be considered where practicable and safe;

  • promotional photography, video and testimonials are dealt with separately and are voluntary;

  • Kudos Driving cannot guarantee that I will pass a driving test; and

  • these Terms do not remove or restrict my statutory consumer or other legal rights.



If the Client does not agree with, or is unwilling to commit to and be bound by these Terms and Conditions, then DO NOT enter into any agreement with Kudos Driving and its representative or use any its services.
