Kudos Driving respects your privacy and is committed to handling personal information fairly, securely and transparently.
This Privacy Notice explains what personal information Kudos Driving may collect, why it is collected, how it is used, when it may be shared and the rights you have in relation to your information.

For data-protection purposes, Kudos Driving is the data controller for the personal information it processes in connection with its driving tuition and related services, unless otherwise stated.
2. WHAT INFORMATION MAY WE COLLECT?
Depending on the services you use and the information you choose to provide, Kudos Driving may collect:
Contact and identification information
name;
address;
telephone number;
email address;
date of birth where relevant;
emergency contact details where provided or necessary.
Driving and tuition information
provisional or full licence information;
lesson bookings;
attendance;
driving progress;
lesson records;
test information;
payment and transaction records;
relevant communications concerning your tuition.
Learning and communication information
You may choose to tell us about:
learning preferences;
communication preferences;
sensory needs;
accessibility requirements;
disabilities;
neurodivergence;
anxiety or other circumstances affecting how you learn.
You do not normally need to provide a medical diagnosis merely to request a teaching adjustment.
Please provide only information that is relevant to your tuition or safety.
3. HEALTH AND SPECIAL CATEGORY INFORMATION
Some information concerning health or disability may constitute special category personal data under UK data-protection law.
Where Kudos Driving processes information falling within this category, we will identify both an appropriate Article 6 lawful basis and, where required, an appropriate Article 9 condition.
Where explicit consent is relied upon, it will be requested separately and must be freely given, specific, informed and capable of being withdrawn.
Providing information about a learning need is not intended to require a Client to disclose a diagnosis.
The ICO confirms that special-category data requires both an Article 6 lawful basis and a separate Article 9 condition where applicable. (ICO)
4. WHY DO WE USE YOUR INFORMATION?
We may use personal information to:
arrange and administer driving lessons;
communicate with you;
maintain lesson and progress records;
provide driving tuition;
adapt teaching to your learning or communication needs where appropriate;
administer payments;
arrange or support driving-test arrangements;
maintain appropriate business records;
meet legal and regulatory obligations;
deal with complaints;
investigate incidents;
maintain safety;
establish, exercise or defend legal claims;
maintain insurance and deal with insurers where necessary; and
protect the legitimate interests of Kudos Driving and its Clients.
5. OUR LAWFUL BASES
Depending on the circumstances, Kudos Driving may rely upon one or more of the following lawful bases:
Contract
Processing may be necessary to provide the driving tuition or other service you have requested.
Legal obligation
Processing may be necessary for compliance with a legal obligation.
Legitimate interests
Processing may be necessary for legitimate business, safety, administration, insurance, security or legal purposes, provided that your rights and interests do not override those interests.
Consent
Where consent is the appropriate lawful basis, we will request it separately and clearly.
Consent is particularly relevant to optional activities such as promotional photography, video and testimonials.
The ICO states that consent should not normally be bundled into general terms and conditions where the processing is not necessary for the service. (ICO)
6. PHOTOGRAPHS, VIDEO AND TESTIMONIALS
Kudos Driving will not treat acceptance of the Terms & Conditions as consent to use an identifiable Client’s photograph, video or testimonial for promotional purposes.
Where promotional material requires consent, a separate consent form will be provided.
You may choose separately whether to consent to:
website use;
social-media use;
digital advertising;
printed promotional material;
use of your first name;
use of a testimonial; and
reasonable editing or formatting.
You may withdraw promotional consent at any time.
The ICO recommends granular consent where different processing purposes are involved. (ICO)
7. DASHCAM AND IN-CAR RECORDING
Kudos Driving may use dashcam or other in-car recording equipment for purposes such as:
road and passenger safety;
incident investigation;
insurance;
security;
legal protection;
responding to complaints; and
other legitimate and lawful purposes.
Where recording includes identifiable personal information, Kudos Driving will provide appropriate information about the processing.
Recordings will not automatically be used for promotional purposes.
Where a separate consent is required for a particular use, that consent will be obtained separately.
8. WHO MAY RECEIVE YOUR INFORMATION?
Where necessary and lawful, information may be shared with:
the DVSA;
driving-test booking or administration services;
insurers;
professional advisers;
payment providers;
IT or software service providers acting on our behalf;
legal or regulatory authorities where required;
emergency services where necessary; and
other organisations where you have asked us to communicate with them or where the law permits or requires disclosure.
We will not sell your personal information.
9. HOW LONG DO WE KEEP YOUR INFORMATION?
Kudos Driving will retain personal information only for as long as reasonably necessary for the purpose for which it was collected, taking account of:
legal requirements;
tax and accounting requirements;
insurance requirements;
complaint or dispute periods;
safeguarding considerations;
legal claims; and
legitimate business needs.
Different categories of information may therefore be retained for different periods.

10. SECURITY
Kudos Driving will take reasonable technical and organisational measures to protect personal information against unauthorised access, loss, destruction, misuse or disclosure.
Access to personal information will be limited to people who reasonably need it for their role or the relevant purpose.
11. YOUR DATA-PROTECTION RIGHTS
Depending on the circumstances, you may have rights including:
the right to be informed;
the right of access;
the right to rectification;
the right to erasure;
the right to restrict processing;
the right to data portability;
the right to object; and
rights relating to certain automated decision-making and profiling.
These rights are subject to legal conditions and exceptions.
You may also withdraw consent where processing is based on consent.
Withdrawing consent does not affect processing that was lawful before withdrawal.

13. CHILDREN AND UNDER-18 CLIENTS
Kudos Driving may provide tuition to Clients under 18.
We will take appropriate account of age, safeguarding and professional-boundary considerations.
Where appropriate and lawful, information may be shared with a parent, guardian or person with parental responsibility regarding practical arrangements or safeguarding.
Promotional photography, video and testimonials involving an under-18 Client will be handled through the separate media-consent process.
14. INTERNATIONAL TRANSFERS
Where personal information is transferred outside the UK, Kudos Driving will ensure that any transfer is carried out in accordance with applicable data-protection requirements.
Where appropriate, information about the relevant safeguards will be made available.
15. MARKETING
Kudos Driving may use personal information for marketing where there is an appropriate lawful basis and, where required, consent under applicable electronic-marketing rules.
Promotional photographs, videos and testimonials will be dealt with through the separate consent process where consent is relied upon.
16. CHANGES TO THIS PRIVACY NOTICE
Kudos Driving may update this Privacy Notice from time to time to reflect changes in law, guidance, technology or the services provided.
The latest version will be made available to Clients.
