KUDOS DRIVING SCHOOL TERMS AND CONDITIONS
This agreement forms a contract between you the Client and Kudos Driving School and its representatives.
This document contains the Terms and Conditions for "Kudos Driving School". It is based on the “Code of Practice for Approved Driving Instructors”. These are intended to protect the interests of both the Client and Kudos Driving School and its representatives. The Client is strongly recommended to be familiar with its contents before entering into any agreement with Kudos Driving School and its representatives. You may also wish to seek advice from an independent party.
1) Lesson Appointment Card
a) A lesson appointment card will be issued either before, or on the first lesson. Clients are required to carry the card so that at the end of a lesson the next appointment/s can be entered and a record of achievement maintained.
2) Driving Licence
a) Clients MUST personally ensure that they are the holders of a valid, signed, current driving licence. This must be produced at the first lesson, and may be regularly checked by the driving instructor. It is a requirement to present the licence for both DSA tests.
b) Clients MUST inform their driving instructor if they receive any endorsements on their licence during the time they are receiving tuition with Kudos Driving School and its representatives.
c) Clients MUST inform Kudos Driving School and its representatives of any special needs or medications that might affect their ability to drive.
3) Client Well-being
a) In the interest of comfort and safety, Clients are advised to wear suitable footwear and comfortable clothing which do not restrict movement. Please ask your instructor for any further advice.
4) Tuition Fees
a) Tuition fees are as stated in the fees section of these terms of business and are payable in advance. A lesson is not considered confirmed unless full payment has been received in advance. All accounts must be cleared before taking the official practical driving test.
5) Postponement of a Lesson by Kudos Driving School and its Representative
a) If by reason of a vehicle failure or other emergency a lesson has to be postponed at short notice, an alternative appointment will be made with mutual consent. If the postponement is a driving test, the Kudos Driving School and its representative will be responsible for the test fee if it cannot be cancelled within the required time (see paragraph 7). This is on condition of the Client continuing lessons with Kudos Driving School and its representative. Clients will appreciate that it may not always be possible to notify cancellation if a breakdown occurs on the way to a lesson.
b) Driving tests take priority over lessons. This means pre-booked lessons may have to be cancelled or postponed if Kudos Driving School and its representative receives short notice of a driving test appointment for another client.
c) Except as provided for in a) above, Kudos Driving School and its representative will give notice of rearrangement or postponement of a lesson within the same time limit as the Kudos Driving School and its representative imposes upon a Client postponing or cancelling a lesson.
d) If circumstances arise that a change of instructor becomes necessary, the Client shall have the right to decline and discontinue lessons with Kudos Driving School and its representative.
6) Postponement or Cancellation of Lessons by Clients
a) At least 2 clear working days (48 hours) notice of postponement or cancellation of a lesson is required. Please note that Sundays and public holidays are not counted as working days. Late cancellations will be charged at normal lesson rates as specified in the fees section.
b) Notice MUST be given to Kudos Driving School and its representative either by text, telephone or email. The notice shall be deemed to have been served on the day that the communication is received by Kudos Driving School and its representative premises. This notice will be recorded.
7) Postponement or Cancellation of a Test (Theory or Practical)
a) The attention of the Client is drawn to the fact that a statutory period of notice is required under government regulations for the cancellation or postponement of any test.
b) If possible, the Client will be given sufficient notice of cancelling the test. Kudos Driving School and its representative cannot be held responsible for the loss of the test fee if the Client fails to immediately notify the test booking office. The address and telephone number is given on the test appointment document.
c) KUDOS DRIVING SCHOOL AND ITS REPRESENTATIVE CANNOT BE HELD RESPONSIBLE FOR ANY POSTPONEMENT OR CANCELLATION OF A TEST BY THE TESTING AUTHORITY IRRESPECTIVE OF WHATEVER NOTICE IS GIVEN.
d) Clients should note that when lessons or tuition vehicle hire are cancelled at short notice because of a cancellation by the testing authority, fees are still payable. It may be possible for Clients to claim lost fees from the testing authority.
8) Kudos Driving School and its Representative Guarantee
a) Kudos Driving School and its Representative guarantee that only legally authorised instructors will be giving tuition.
b) The Driving Instructors’ official authorising documents will be displayed on the windscreen of the car, and may be inspected freely at any time.
c) Clients may be accompanied on their lesson by a supervising instructor, whose job it is to ensure that tuition given meets the required standards.
d) If an authorised trainee instructor is used, a Client may expect a senior supervising instructor present during some of the lessons. This is a 'DVSA' requirement and in the public interest.
9) The Driving Test
a) The instructor will advise the appropriate time to make any application for the theory and practical driving tests. The advice will be based on the Client’s progress to date. It does NOT imply that the necessary standard has been reached, or that it will be reached by the appointed test date. Kudos Driving School and its Representative will not hesitate to advise where necessary test amendments. This is intended to save the Client expense, unnecessary failure, and the consequent delay in waiting for another test and obtaining a full licence.
b) Kudos Driving School and its representative reserves the right to withhold the use of the training vehicle for the test or a lesson, if in the opinion of the instructor the Client is:
i) Not at driving test pass standard.
ii) Medically unfit (including eyesight).
iii) Appears under the influence of drugs or alcohol.
iv) Is not properly licensed to drive.
v) Consistently fails to keep, or is late for appointments.
vi) Falls into arrears over payment.
vii) If, for any other reason, the instructor considers the Client unsafe to handle a motor vehicle.
c) Clients may be accompanied on their test by a 'DVSA' supervising examiner, whose job it is to ensure that official standards of testing are observed by examiners. This is a 'DVSA' requirement and is in the public interest.
d) The Client is reminded that when attending the theory or practical test, the required documents MUST be taken. The instructor will advise. Failure to comply with this regulation will mean the examiner will have to cancel the test. The test fee will be forfeit and the Client will be required to apply for a replacement test.
e) In the event of the test appointment being sent to the Client, the Client is required to notify Kudos Driving School and its representative as soon as possible, the test date, time and location. Kudos Driving School and its representative cannot accept any responsibility for booking an incorrect time or date for a test unless the appointment document is produced. If the appointment is sent to Kudos Driving School and its representative, the Client will be shown the document on their next lesson or notified as soon as possible. The document will be handed to the Client on request.
10) Lessons in Clients' Own Car
a) Lessons may be given in a Clients' own car if the instructor is willing to do so, on condition that it is clearly understood:
i) The car is fully insured for teaching for reward. This must be confirmed in writing, by the vehicle underwriters.
ii) The instructor is covered by such insurance to drive the car. This must be confirmed as above.
iii) The instructor can in no way be held liable for any damage or accident to the Clients' own vehicle. While the instructor will make every effort to prevent the Client having an accident, or damaging the car, it will be realised that their control is very limited. If Clients wish to have lessons in their own car a second rear view mirror must be provided for the instructor. In view of the extra responsibility entailed, there will normally be no reduction in lesson charges.
11) Kudos Driving School Insurance
a) Kudos Driving School and its representative cars are fully insured for tuition and driving tests. The insurer’s name is: DARRYL GRAY - ADI 426902. The certificate of insurance is available for inspection.
b) No liability of any kind can be accepted by Kudos Driving School and its representative for the loss of, or damage to any property belonging to, or in the possession of the client.
12) Legal Liability
a) Clients should be aware the instructor's primary objective is to promote road safety, and in doing so, he/she will have to issue instructions which the Client MUST be prepared to carry out without undue argument.
b) The instructor will make every effort to train the Client to the highest standard, but can in no way be held liable for any errors committed whilst driving and not accompanied by the instructor either before or after a test pass.
c) During an official driving test the Client is in charge of the vehicle and is liable for all fines and charges levied as a result of any motoring offence committed.
13) Complaints
a) If the Client is unhappy with any aspect of the tuition notification should be made to Kudos Driving School and its representative without delay, and not later than seven days from the date on which the cause of the complaint arose. Every effort will be made by Kudos Driving School and its representative to satisfactorily deal with the complaint. These “Terms and Conditions” and the “Code of Practice for Approved Driving Instructors” form the basis for any negotiations.
b) Should any dispute remain unresolved, the Client has the right to refer the matter in writing to Kudos Driving School, Cricketts Cottage, 197 London Road, Chippenham, Wiltshire, SN15 3AW.
14) Fees And Normal Lesson Rates
All fees are subject to adjustment at two weeks notice. Duration of a "standard lesson" is approximately 2 hours.
a) The rate for a 1 hour lesson (manual gears) is £70.
The normal rate for a "standard lesson" manual gears is £90. The rate is £95 if commencing between the hours of 6am-8am & 8pm-10pm
b) The rate for a 1 hour lesson (automatic gears) is £50.00.
The normal rate for a "standard lesson" automatic gears is £85. The rate is £90 if commencing between the hours of 6am-8am & 8pm-10pm.
c) 20 hours (10 lessons) booked & paid for in advance is £900.
d) 40 Hours Fast Pass Course (inclusive of test fee) booked & paid for in advance is £1800.
e) 60 Hours Fast Pass Course (inclusive of test fee) booked & paid for in advance is £2700.
f) Guaranteed Pass Course (inclusive of up to 3 attempts at the theory test and up to 5 attempts at the practical driving test) is £4500.
g) The hire of the tuition car and instructor for the driving or theory test is £90. Kudos Driving School and its representative will NOT represent any Client that has not received a minimum of 10hrs training with Kudos Driving School and its representative and has not reached the required driving test standard.
Guaranteed Pass Course - Complete Driving Course Includes:
DVSA Theory Test fees. This is limited to a maximum 3 attempts. DVSA Practical Test fees and as much driver training as required to reach or exceed the minimum safety standard required to sit the DVSA practical driving test. This is limited to a maximum 5 attempts. Training is undertaken in both manual and automatic vehicles and covers Bristol, Bath, Chippenham, Swindon and surrounding areas.
15) Offers And Promotions
a) Offers and promotions are open to new drivers only and are purely to assist in the continuity of learning, leading to the Client passing the driving test within the UK average time frame.
b) All offers are non-refundable with the complete balance to be paid in advance unless otherwise specified. There MUST NOT be a break between the offer lessons of more than 2 weeks, otherwise all remaining lessons will be forfeit.
c) All other lessons are to be taken congruently and with no longer than a 1 month interval between them. The offer will not apply to those individuals who book a test without Kudos Driving School and its representative prior knowledge. A test can only be booked with the full consent of the driving instructor.
16) Lessons
a) Lessons normally start from the client’s home or a place agreed by mutual arrangement. Clients are advised to be punctual for appointments. The instructor will wait 15 minutes only. A reciprocal waiting time may become necessary for the arrival of the instructor who may be delayed due to some unforeseen circumstance.
b) The lesson will commence from the appointed time.
c) If the instructor is delayed, the lesson will commence from the instructor’s arrival time.
17) Payments
Payments can be made through Bank Transfer, Apple Pay, PayPal, Debit or Credit Card, Cash or Cheque. Cheques should be made payable to: Darryl Gray and are required to be cleared prior to the commencement of any lesson.
If the Client does not agree with, or is unwilling to commit to and be bound by these Terms and Conditions, then DO NOT enter into any agreement with Kudos Driving School and its representative or use any its services.
